I am appealing the processing and redaction of my FOIA Request: 20-06001-F. What I requested: “Please provide a copy of all Standard Form 95 filings AND decisions for George Air Force Base, CA.” It is my understanding the over the last 30 years there were several groups of Air Force personnel, veterans, and dependents that filed for damages for injuries that were the result of a toxic exposure(s) at the former George Air Force Base, CA. George AFB is an Air Force Superfund site. Additionally, several people that filed for damages told me that the Air Force denied these claims under the Feres doctrine. (Feres v. United States, 340 US 135) What I received were 18 Standard Form 95 filings that were all filed in 2020. I did not receive any of the older fillings or decision letters. I did not receive any of the supporting evidence that was included in the SF 95 filings. Some of the records that I received were heavily redacted (entire pages were blacked out). 1) The requested records were clearly described, and the FOIA officer failed to provide the requested records. a) The DC Circuit has previously held that agencies have a duty to construe the subject material of FOIA requests liberally to ensure responsive records are not overlooked. See Nation Magazine, Washington Bureau v. US Customs Service, 71 F.3d 885, 890 (D.C. Cir. 1995). 2) The FOIA officer failed to use segregable redaction. a) The agency has a duty to release any reasonably segregable portion of a responsive record must be provided after the redaction of any allegedly exempt material. 5 USC § 552(b). |
